Terms of Service (ARRA)
-
OVERVIEW
These Terms of Service (“Terms”) apply to your use of this website (the “Site”) and any purchases made through it.
The Site is operated by Kanita Bakery Limited (trading as ARRA) (“we”, “us”, “our”). Our online store is hosted on Shopify.
By using the Site or placing an order, you agree to these Terms and our Privacy Policy (click here).
If you do not agree, do not use the Site.
Nothing in these Terms affects your statutory rights as a consumer under applicable law.
2. USING THE SITE
By placing an order, you confirm you are legally able to enter into a contract.
You agree to provide accurate and complete information (including email, billing and delivery details) and to keep it up to date.
3. PRODUCTS AND INFORMATION
We aim to describe and display products as accurately as possible. However, product appearance (including colour) may vary depending on your device and screen settings.
We may update product information, prices, availability, and ranges at any time.
Allergens
Allergen information is shown on each product page and on product packaging. Please review this information before ordering. If you have a severe allergy, contact us before placing an order.
Perishable and heat-sensitive products
Some products may be perishable or heat-sensitive (particularly filled or fresh items). Storage guidance and best-before information will be provided on packaging and/or the product page.
4. ORDERS
When you place an order, you are making an offer to purchase products from us.
Order confirmation and acceptance
After you place an order, we will send an email acknowledging receipt. Your order is accepted when we dispatch it and send a dispatch confirmation email.
Changes and cancellations
If you need to request a change (including address updates), contact us as soon as possible. We may be able to help before dispatch. Once an order has been dispatched, changes and cancellations are not possible.
Change-of-mind returns
Due to the nature of food and perishable goods, we do not accept returns, exchanges, or cancellations for change of mind, except where required by law. This does not affect your rights where goods are faulty, damaged, incorrect, or not as described.
Order issues, replacements and refunds
Order issues, replacements and refunds are handled in accordance with our Refund Policy (click here).
Resale
Products are sold for personal use. You must not purchase products for resale or commercial distribution without our written permission.
5. PRICES, TAXES AND PAYMENTS
Prices are shown on the Site and may change at any time. The price charged will be the price shown at checkout when you place your order.
Shipping charges are shown at checkout.
International orders: you may be responsible for local import duties, taxes, and customs charges in your country. These are not included in our prices unless stated at checkout.
6. SHIPPING AND DELIVERY
Our Shipping Policy can be found by clicking here.
We provide tracking for all orders. Delivery times are estimates and are not guaranteed. Delays can occur due to factors outside our control (for example, courier disruption, customs processing, severe weather, or peak delivery periods).
Heat conditions and dispatch pauses
Chocolate is sensitive to heat. In periods of high temperatures, we may adjust packaging, delivery options, or temporarily pause dispatch to protect product quality. If this affects your order, we will contact you.
Responsibility on delivery
Responsibility for your order passes to you on delivery.
Customer responsibilities
Please ensure your delivery address and contact details are correct at checkout. If delivery fails due to incorrect or incomplete information, we may be able to resend your order. Additional shipping costs may apply.
7. GIFT ORDERS
We accept gift orders with different billing and delivery details. We do not include pricing in the parcel.
8. INTELLECTUAL PROPERTY
The Site and its content (including text, imagery, branding, design, and logos) are owned by or licensed to us and protected by UK and international intellectual property laws.
You may use the Site for personal, non-commercial purposes only. You must not copy, reproduce, distribute, modify, or publicly display any part of the Site without our written permission.
9. THIRD-PARTY SERVICES AND LINKS
The Site may include links to third-party websites or services. We are not responsible for third-party content, policies, or actions. Your use of third-party services may be subject to their own terms.
10. PRIVACY
Our Privacy Policy explains how we collect and use personal information: (click here)
11. REVIEWS AND FEEDBACK
If you submit reviews, feedback or other content (“Feedback”), you grant us a worldwide, royalty-free licence to use, reproduce, publish and display that Feedback for operating and promoting our business, subject to applicable law.
You confirm you have the right to submit Feedback and that it does not infringe third-party rights or contain unlawful content. We may remove Feedback where we reasonably believe it breaches these Terms.
12. ERRORS AND CORRECTIONS
We may correct errors or inaccuracies on the Site at any time. If a material error affects your order (for example, an incorrect price), we may cancel the order and refund you.
13. PROHIBITED USE
You must not misuse the Site, including by violating laws, infringing intellectual property, transmitting malicious code, attempting unauthorised access, or scraping/harvesting data without consent.
We may suspend or terminate access to the Site if we reasonably believe you have breached these Terms.
14. PRE-ORDERS, SUBSCRIPTIONS AND FUTURE SERVICES
From time to time we may offer pre-orders, subscriptions, or limited releases. Any such offerings may be subject to additional terms disclosed at checkout or on the relevant product page. Where additional terms apply, they will take precedence to the extent of any conflict.
15. LIABILITY
The Site is provided on an “as available” basis. We do not guarantee that the Site will be uninterrupted or error-free.
Nothing in these Terms limits liability where it would be unlawful to do so, including for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
To the extent permitted by law, we are not liable for indirect or consequential losses, or for delays and failures caused by events outside our reasonable control.
16. SEVERABILITY
If any provision is found unenforceable, the remaining provisions will remain in effect.
17. ENTIRE AGREEMENT
These Terms and the policies referenced within them constitute the entire agreement between you and us relating to use of the Site and purchases through it.
18. ASSIGNMENT
We may transfer our rights and obligations under these Terms. You may not transfer your rights or obligations without our written consent.
19. GOVERNING LAW
These Terms are governed by the laws of England and Wales.
If you are a consumer and local mandatory consumer protection laws in your country apply, nothing in these Terms is intended to exclude those mandatory rights.
20. CHANGES TO THESE TERMS
We may update these Terms from time to time. The latest version will always be posted on this page. If changes are material, we will take reasonable steps to notify you where required by law.
